On September 22, 2026, Bloomberg Law quoted Gruenstein Law partner Thomas H. Lee on the deference federal courts owe President Trump's national security rationale for building his planned triumphal arch in northern Virginia near Arlington National Cemetery: “The president is owed deference on national security calls. Whether this is one where that deference will carry the day is debatable.”
Bloomberg Law also reported that “Lee, a partner at Gruenstein Law, said ‘the strongest possible argument’ for the court to defer to the administration on its national security rationale for the arch would be to install sensors to monitor airspace over the capital.”
