On September 10, Gruenstein Law submitted an amicus brief on behalf of the Institute for Free Speech in Jouppi v. Alaska (No. 25-246).

The brief argues that the Eighth Amendment’s Excessive Fines Clause—born out of efforts to stop governments from using monetary penalties to silence political and religious dissenters—remains just as vital today, as campaign-finance regimes increasingly stack per-violation civil penalties into fines reaching into the millions of dollars, often with no connection to any actual harm.
